A 49-year-old man whose SUV was parked and running outside a closed Ocala store is facing several drug-related charges after fentanyl and cocaine were allegedly found in his pockets.
At around 11:35 p.m. on Thursday, January 9, an Ocala Police Department officer spotted a gray Ford Escape that was sitting in the parking lot of Roses Discount Store (2640 NE 14th Street) with its “running lights on.” The arrest report stated that the store and surrounding businesses were closed, which prompted the officer to approach the vehicle.
The officer made contact with the SUV’s driver and sole occupant, identified as Belleview resident Phillip Paul Lopiano. He told the officer that he was “waiting on a friend that never showed up,” according to the report.
While speaking with the officer, Lopiano allegedly reached towards the center console of the SUV and positioned himself so that his right arm was covering it. When the officer asked about the center console, Lopiano allegedly stated that he had “pipes and everything.”
The report stated that Lopiano leaned back, and the officer observed a glass smoking pipe in the center console. Lopiano was then instructed to exit the vehicle, and he was detained in handcuffs.
The glass pipe field-tested positive for the presence of fentanyl.
During a pat-down search of Lopiano, the officer found several clear plastic bags in his front left pocket that contained a brownish rock-like substance, which field-tested positive for fentanyl. One of the bags contained another powder that field-tested positive for the presence of crack cocaine, according to the report.
Inside the SUV, the officer allegedly found two plastic bags filled with used hypodermic needles.
The report stated that the seized fentanyl weighed a total of nine grams, and the cocaine had a raw weight of eight grams.
Lopiano was arrested and transported to Marion County Jail, where he is currently being held without bond. He is being charged with trafficking in fentanyl, possession of cocaine, and possession of drug paraphernalia.
On Tuesday, February 11, Lopiano is scheduled to appear in court at 9 a.m., according to jail records.
